1. Introduction & Acceptance

Welcome to Talegate (“we,” “us,” “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, mobile applications, and related services (collectively, the “Service”). By using the Service, you agree to these Terms. If you do not agree, you may not use the Service.

We are committed to protecting children’s privacy and complying with the U.S. Children’s Online Privacy Protection Act (COPPA).

2. Users & Eligibility

• Our Service is directed toward children and families.
• If you are under the age of majority in your jurisdiction (e.g. under 18 in many places), you must have a parent or legal guardian’s permission to use the Service.
• By registering or using the Service, you represent that you are at least the minimum age required to form a binding contract, or that such binding contract is formed with your parent or guardian’s consent.

3. COPPA Compliance & Parental Consent

3.1 Parental Consent Required
If you are under 13 years old, we will obtain verifiable parental consent prior to collecting, using, or disclosing any personal information from you.

3.2 Notice to Parents / Direct Notice
We will provide direct notice to a child’s parent or guardian of our information collection practices, the types of personal information collected, how that information is used, and how parents may review or delete the information.

3.3 Limited Collection
We only collect personal information that is reasonably necessary to operate the Service (e.g. to create a user profile, save progress, personalize stories).

3.4 Parental Rights
Parents and guardians can (a) review their child’s personal information, (b) revoke consent at any time, (c) request deletion of their child’s personal information, and (d) prevent further collection of personal information.

3.5 Security & Retention
We implement reasonable security measures to protect children’s information and will retain it only as long as necessary to fulfill the purposes for which it was collected.

4. Account Registration & User Content

4.1 Account Information
When creating an account, you agree to provide accurate, complete, and updated information. You are responsible for safeguarding your account credentials and for any activities under your account.

4.2 User Content / Created Stories
Users may create or upload content (characters, stories, images). You retain ownership of that content, but by submitting, you grant Talegate a license to host, display, use, and modify it as needed to provide the Service (non-exclusively, worldwide, royalty-free).

4.3 Acceptable Use
You must not misuse the Service (e.g. harass others, upload inappropriate content, attempt to hack). We reserve the right to remove or suspend accounts that violate these rules.

5. Limitation of Liability & Warranty Disclaimer

The Service is provided “as is” and “as available,” without warranties of any kind. To the fullest extent permitted by law, Talegate and its affiliates disclaim all implied warranties, including fitness for a particular purpose and non-infringement.

In no event will we be liable for indirect, incidental, special, or consequential damages arising from your use of the Service, even if advised of the possibility of such damages.

6. Modifications to Service & Terms

We may modify the Service, features, or these Terms at any time. We’ll post the updated Terms and change the “Last Updated” date. If the changes are significant, we’ll notify you or your parent/guardian directly when possible. Your continued use constitutes acceptance of those changes.

7. Termination

We may suspend or terminate your access or accounts if you or your parent/guardian breach these Terms, or if we suspect misuse. Even after termination, Sections such as Ownership, Liability, and COPPA obligations survive.

8. Governing Law & Dispute Resolution

These Terms will be governed by the laws of Texas, without regard to conflict of laws. Any legal actions shall be brought in the courts of that jurisdiction.

10. Additional Provisions

• Severability: If any clause is found invalid, others remain in effect.
• Waiver: Failure to enforce a right is not a waiver of rights.
• Assignment: You may not assign your rights; we may assign ours.
